Introduction and Acceptance of Terms

Welcome to Banana Pro ("Banana Pro", "we", "us", "our"), an AI Image & Video Generator that converts short text prompts and reference images into generated visuals. These Terms govern your access to and use of the Banana Pro website, application, API, and related services (collectively the "Service"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

Banana Pro is an independent AI generation interface. Image and video generation may be powered by third-party AI models and providers, including Google Nano Banana / Gemini image models, GPT Image models, Sora, Veo, Kling, Seedance, Midjourney-compatible generation services, and other supported providers as available in the product. Banana Pro is not affiliated with, endorsed by, sponsored by, or an official product of Google, OpenAI, ByteDance, Midjourney, or any other third-party model provider. "Nano Banana" and other model names are trademarks or identifiers of their respective owners.

Summary (Non‑binding Overview):

1. You generate content using AI models; you must use prompts responsibly.
2. You retain rights to lawful outputs you generate (subject to model / legal limitations) and grant us a license to host & process them.
3. Misuse, including NSFW or other prohibited content, may result in blocked requests, credit loss, suspension, or termination.
4. Paid plans auto‑renew unless canceled.
5. We provide the Service "as is" without warranty.

Use of the Service

Banana Pro enables the submission of prompts, reference media, and generation settings, and returns generated images or videos and related metadata. You agree to:

• Use the Service only for lawful purposes.
• Comply with content and safety restrictions, including the strict no-NSFW policy below.
• Not probe, scan, or overload infrastructure or attempt to extract model weights / system internals.
• Respect rate limits and fair use boundaries.

User Accounts and Registration

1. Account Creation: Certain features (generation history, API access, billing) require an account. Provide accurate information and update it as needed.
2. Account Security: Maintain the confidentiality of credentials / API keys. Activity under your account is your responsibility.
3. Notification: Inform us promptly of suspected unauthorized access.
4. Age / Eligibility: You represent you are legally permitted to use the Service in your jurisdiction.

Content and Intellectual Property Rights

1. Your Prompts & Outputs: Subject to applicable law and these Terms, you retain rights (including any assignable copyright) in lawful images you generate. You grant Banana Pro a worldwide, non‑exclusive, transferable, sublicensable, royalty‑free license to store, process, cache, display, transmit, and (where you opt in to public galleries / showcases) display them for Service operation, improvement, and feature provision.
2. Third‑Party / Model Constraints: Some outputs may resemble training data styles; we do not guarantee uniqueness or non‑infringement.
3. Our Technology: All platform code, infrastructure, UI, models, and trademarks remain the property of Banana Pro or its licensors.
4. Feedback: Suggestions or improvements you provide may be used without obligation or compensation.

Prohibited Activities and NSFW Policy

Banana Pro maintains a strict no-NSFW policy. You may not generate, upload, request, edit, distribute, sell, publish, or attempt to create disallowed content through the Service.

Adult and Sexually Explicit Content

The following content is prohibited:

• NSFW, adult, pornographic, erotic, fetish, sexually explicit, or sexually suggestive content.
• Nudity, partial nudity, exposed intimate body parts, or imagery focused on sexual arousal.
• Explicit sex acts, simulated sex acts, masturbation, sexualized posing, or sexual roleplay.
• Lingerie, swimwear, underwear, transparent clothing, wet clothing, body close-ups, or "sexy" framing when the primary purpose is sexual emphasis.
• Requests to undress, remove clothing, make clothing transparent, "nudify," expose intimate areas, or transform a person into a sexualized image.
• Face swaps, image edits, prompt edits, or style transfers that place any person into a sexual or adult context.

Minors and Age-Sensitive Content

The following content is strictly prohibited and may be reported where required by law:

• Any sexualized, nude, suggestive, exploitative, or romanticized depiction of a minor or a person who appears under 18.
• "Barely legal," school-age, childlike, age-regressed, teen-coded, or ambiguous-age sexual content.
• Fictional, illustrated, anime, game, cartoon, or generated characters presented as minors in a sexualized context.
• Attempts to age up a minor, make an adult appear younger for sexual purposes, or use school uniforms, childlike features, or youth cues to create sexual appeal.

Non-Consensual, Abusive, and Privacy-Violating Content

You may not create or request:

• Non-consensual intimate imagery, revenge porn, sexual deepfakes, or sexualized depictions of real people.
• Content involving sexual coercion, harassment, humiliation, blackmail, exploitation, trafficking, assault, rape, or abuse.
• Voyeuristic, hidden-camera, upskirt, downblouse, bathroom, locker-room, or private-location sexual content.
• Sexualized edits of uploaded photos of celebrities, public figures, private individuals, ex-partners, coworkers, classmates, or any identifiable person.
• Content that reveals, guesses, reconstructs, or emphasizes intimate anatomy from a clothed or private image.

Extreme or Illegal Sexual Content

You may not create or request sexual content involving incest themes, animals, corpses, severe injury, blood, bodily fluids, torture, intoxication, unconsciousness, inability to consent, or other extreme, exploitative, or illegal scenarios.

Safety Evasion and Abuse

You also agree not to:

• Attempt to bypass, disable, evade, or manipulate safety filters, moderation systems, content restrictions, prompt screening, provider policies, payment processor requirements, or compliance checks.
• Use coded language, misspellings, euphemisms, prompt splitting, image references, external links, or iterative edits to reach a prohibited NSFW result.
• Upload, link to, or use third-party NSFW material as a reference, mask, seed, or editing source.
• Re-upload blocked content, retry rejected prompts, or create multiple accounts to continue policy-violating behavior.
• Reverse engineer, decompile, circumvent, or misuse rate limits / usage meters.
• Misrepresent generated content origin (e.g., claiming human authorship where disclosure is legally required).
• Use automated scraping of other users' private content or metadata.
• Upload or prompt with data you lack rights to (confidential, proprietary, personal data without consent).

Content Moderation

We may automatically screen prompts, uploads, generation requests, outputs, and usage patterns before or after AI media generation, including through CREEM's Moderation API and other safety systems. Requests may be blocked, generated content may be removed, credits may be withheld for policy-violating attempts, and accounts may be suspended or terminated when we determine that a prompt, upload, output, or usage pattern violates these Terms, the NSFW policy above, provider policies, payment processor requirements, or applicable law.

Privacy and Data Collection

Data practices are described in our Privacy Policy. By using the Service you consent to processing consistent with that Policy.

Pricing, Plans and Credits

1. Plans & Renewals: Paid subscriptions renew automatically unless canceled before the renewal date.
2. Credits: Generation may consume credits (usage unit). Unused credits may expire as stated at purchase.
3. Billing: You authorize us / our processor to charge the payment method on file.
4. Changes: We may modify plan features or pricing with prior notice where required. Continued use after changes constitutes acceptance.
5. Refunds: Except where required by law, charges are reviewed under our Refund Policy; we may consider goodwill adjustments at our discretion.

Suspension & Termination

We may suspend or terminate access for violations of these Terms, legal risk, suspected fraud, security threats, non‑payment, or abusive usage. You may terminate by ceasing use and (if applicable) canceling any active subscription. Certain clauses (IP, disclaimers, liability limits, governing law) survive termination.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON‑INFRINGEMENT, OR AVAILABILITY. WE DO NOT WARRANT THAT OUTPUTS WILL BE UNIQUE OR FREE FROM THIRD‑PARTY CLAIMS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NANOBANA AND ITS SUPPLIERS / LICENSORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. IN NO EVENT WILL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF (A) AMOUNTS PAID BY YOU IN THE 3 MONTHS PRECEDING THE CLAIM OR (B) USD $50.

Indemnification

You agree to defend, indemnify and hold harmless Banana Pro, its affiliates, officers, directors, employees, and agents from claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your misuse of the Service; (b) violation of these Terms; (c) infringement or violation of third‑party rights; or (d) content you generate, submit, or distribute.

Governing Law and Dispute Resolution

These Terms are governed by applicable laws of the jurisdiction in which we operate (without regard to conflict rules). Disputes shall first attempt informal resolution by contacting support. If unresolved, and unless prohibited by law, disputes may be submitted to confidential binding arbitration in a mutually agreed venue. YOU WAIVE CLASS ACTION RIGHTS TO THE EXTENT PERMITTED BY LAW.

Changes to These Terms

We may revise Terms periodically. Material changes (pricing model, IP usage scope) will be notified via email or in‑app notice where practicable. Continued use after effective date constitutes acceptance.
